Terms of sale and use

Purpose

These terms govern the sale of the ULTMX Quatro product to consumers and the use of this site. Placing an order means accepting them without reservation.

They apply to consumers residing in the European Union. The terms applicable are those in force on the day of the order.

Seller identity

Product and price

The price is shown in euros and includes the taxes due to the seller. Delivery costs, import VAT and any customs duties are shown before the order is confirmed, under the rules in the section “Import VAT and customs duties”.

Ordering

• You add the product to the cart and check its contents.
• You enter your details and your delivery address.
• You review the full summary: product, total price, delivery costs, announced lead time.
• You confirm by clicking a button labelled “order with obligation to pay”.

That wording is required by Article 8(2) of Directive 2011/83/EU. Until you click that button, no sum is due.

Delivery restrictions and accepted means of payment are indicated at the latest at the beginning of the ordering process, in accordance with Article 8(3) of the same directive.

Means of payment

Payment is processed by Shopify (Shopify Payments) or PayPal. The seller does not store your card number. The order is firm once payment is authorised.

Availability

Offers are valid as long as they are displayed. If the product turns out to be unavailable after your order, you are informed without delay and fully refunded.

Delivery and lead times

The announced international shipping time is 15 to 25 business days. The appliance weighs 44.8 kg gross: delivery may require an appointment and suitable access.

If the announced time is exceeded, we apply the commitment described on the “Withdrawal, returns and refunds” page: we offer you, on our own initiative, either a new deadline or cancellation with a refund.

Import VAT and customs duties

The IOSS scheme is reserved for consignments worth 150 € or less. It therefore does not apply to a product sold at 1,290 €. On entry into the Union, import VAT at the rate of the destination country, customs duties and the carrier’s clearance fees are due.

Option 1 — all-inclusive price

The price paid includes import VAT, customs duties and clearance fees. You have nothing to pay on delivery.

Option 2 — taxes at your expense

Import VAT, customs duties and the carrier’s clearance fees remain at your expense and are claimed from you before or on delivery.

[[INCOTERM_DDP_OU_DAP]] — the Incoterm must be settled before launch and only one of these two options kept, displayed before payment.

Transfer of risk

The risk of loss of or damage to the goods passes to you when you take physical possession of the goods, or when a third party you designated, other than the carrier, takes possession of them.

Right of withdrawal

You have 14 days to withdraw without giving any reason, from the physical possession of the goods (Article 9 of Directive 2011/83/EU).

Legal guarantee of conformity

The product benefits from the 2-year legal guarantee of conformity provided by Directive (EU) 2019/771. It is free of charge and exercised against the seller.

This legal guarantee is independent of any commercial guarantee: a commercial guarantee can neither replace nor reduce it.

Commercial guarantee

The store announces a 2-year commercial guarantee. It is added to the legal guarantee of conformity and does not replace it. To use it: [[EMAIL_CONTACT]].

Product safety and GPSR information

In accordance with Regulation (EU) 2023/988, applicable since 13 December 2024, the online offer states:

• the manufacturer’s contact details: [[RAISON_SOCIALE]], [[ADRESSE_SIEGE]], [[EMAIL_CONTACT]];
• the contact details of the responsible person established in the Union: [[PERSONNE_RESPONSABLE_GPSR]];
• the identification of the product: ULTMX Quatro, reference UL-Q4, together with an image on the product page;
• the warnings and safety information, shown on the product page and repeated in the manual supplied with the appliance — a 2000 W household appliance, 220 V – 50 Hz power supply;
• the CE / CB marking announced for the appliance.

Customer reviews

Our review rules, in line with FTC rule 16 CFR Part 465, in force since 21 October 2024:

• We do not filter out or delete genuine negative reviews.
• We make no benefit — discount, gift, entry — conditional on a review being positive.
• Reviews from people connected to the company (employees, relatives, partners) are disclosed as such.
• We publish neither bought reviews nor artificially generated ones.

Intellectual property

The ULTMX trademark, the texts, images, photographs and interface elements of the site are protected. Any reproduction or adaptation, in whole or in part, without prior written permission is prohibited.

Liability

The seller is answerable for the proper performance of the contract. No clause of these terms may deprive the consumer of the mandatory rights granted by law, in particular the legal guarantee of conformity and the right of withdrawal.

Force majeure

Performance of the obligations is suspended in the event of an unforeseeable and irresistible event beyond the parties’ control. If the impediment continues, the order may be cancelled and the sums paid are refunded.

Applicable law and dispute resolution

Regulation (EC) No 593/2008 (Rome I) applies. Under its Article 6, a choice of law — including a law of the United States — cannot deprive the consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.

Changes to the terms

We may amend these terms. The version applicable to your order is the one published when you place it, and we recommend keeping a copy.
